THE B TEAM: Biologi Loyalty Program Terms and Conditions

These Terms and Conditions govern the Biologi Loyalty Program ("The B Team") offered by Biologi Serum Pty Ltd ("Biologi"). By participating in the Program, you agree to these Terms and Conditions.

1. Eligibility

1.1. The Program is open to individuals who are at least 18 years old.

1.2. Employees of Biologi and its affiliates, as well as their immediate family members, are not eligible to participate in the Program.

2. Enrolment

2.1. To enrol in the Program, customers must create an account on Biologi's website (https://biologi.com.au/pages/the-b-team-loyalty) and agree to these Terms and Conditions.

2.2. Customers must provide accurate and complete information during enrolment.

3. Earning and Redeeming Points

3.1. Participants earn points ("Points") by making eligible purchases on the Biologi website. Exclusing wholesale and BBP partners.

3.2. Points may also be earned through other specified actions, such as referring friends or engaging with Biologi's social media accounts.

3.3. Points have no physical cash value and can only be redeemed for rewards offered through the Program.

3.4. Biologi reserves the right to modify the Points earning and redemption structure at any time without prior notice.

4. Reward Redemption

4.1. Participants can redeem Points for rewards listed on the Biologi website.

4.2. Rewards are subject to availability and may be changed or discontinued at any time.

4.3. Once Points are redeemed for a reward, the transaction is final and Points cannot be returned to the participant's account.

4.4. Vouchers redeemed with points can only be used one at a time, there is no coupon stacking available and can not be used with any other Biologi promotion or sale.

5. Program Modifications and Termination

5.1. Biologi reserves the right to modify, suspend, or terminate the Program at any time without prior notice.

5.2. In the event of Program termination, participants will have a limited period to redeem any remaining Points.

6. Privacy

6.1. By participating in the Program, participants consent to the collection, use, and disclosure of their personal information by Biologi and Yotpo in accordance with their respective privacy policies.

7. General Terms

7.1. These Terms and Conditions are governed by the laws of Australia.

7.2. Participation in the Program constitutes acceptance of these Terms and Conditions.

7.3. Biologi reserves the right to disqualify any participant who violates these Terms and Conditions or engages in fraudulent behavior.

Biologi Pty Ltd. believes that beauty products should be cruelty free. We are proud to be Leaping Bunny approved. A global programme, Leaping Bunny requires cruelty free standards over and above legal requirements. 

All of our own brand cosmetic and personal care products are approved under the Cruelty Free International Leaping Bunny programme, the internationally recognisable gold standard for cruelty free products. We adhere to a fixed cut-off date policy and proactively monitor our suppliers to ensure that our products continue to adhere to the leaping Bunny criteria. Our supplier monitoring system is also independently audited.

USER ELIGIBILITY
In order to use the site to purchase goods and submit feedback, as well as to legally enter into contracts, you must be at least 18 years of age. You must provide genuine information about yourself as requested during purchase and feedback. If Biologi detects suspicious or incomplete information, we reserve the right to cancel any business transactions. If you are under 18, you may only use this website with the consent of your parent or guardian who has agreed to the Terms and Conditions herein.

PRICES
Item prices may change. Your shopping cart will reflect the most recent price. Prices exclude shipping and handling charges which will be calculated at checkout. Goods and Services Tax (GST) may be applied where applicable based on shipping address.
Prices held in shopping cart does not reserve the price for the product at that time, and prices are reserved only after an order has been submitted. In the possibility that there is mispricing, Biologi will: charge you the lower price if the item’s correct price is lower, or contact you for instructions if the correct price of an item is higher than stated. Discounts and final sale promotions are not eligible for any other offers, and final sale promotions are not eligible for refund.

PRODUCT INFORMATION
Although we try to keep the site as updated as possible, some information, descriptions, photographs, and prices on our site may not always reflect the most recent correct information.

Biologi has hundreds of successful skin results from customers with sensitive skin that have used Biologi, however, if you have reactive skin, we recommend performing a simple patch test first. Biologi does not recommend the use of any Biologi product on open wounds or broken skin. If you are unsure about starting any new skincare product, please refer to your medical practitioner.  To perform a patch test apply a small amount of the product to clean dry skin. We recommend behind the ear. The general wait time for reaction is approximately 24-48 hours, however in some cases a longer reaction can occur. Please refer to your medical practitioner if you are unsure about patch testing.

PREGNANCY AND INGREDIENTS TO AVOID

During pregnancy, there are many body changes happening including hormones, immunity and even the cardiovascular system. When it comes to pregnancy and the skin, these changes can trigger skin challenges and so during pregnancy we recommend avoiding:

Retinols/Vitamin A/retinoic acid/retinol/retinyl linoleate/retinyl palmitate: Some research has shown that oral retinoids and high dosages of vitamin A could cause birth defects. As a precaution, we advise against the use of retinoids and recommend seeking the advice of your medical practitioner.

Salicylic Acid: Whilst topical Salicylic Acid is generally safe to use during pregnancy, the thought behind avoiding this ingredient during pregnancy is that regular use could lead to a systemic build-up of salicylates, which can have a toxic metabolic effect. Although the amount of saliclate that is absorbed through the skin through the topical application of skincare is negligible to low, it’s important to seek advice from your medical practitioner.

INDIVIDUAL DISTRIBUTION OF PRODUCTS
To set up a business wholesale account with us, register your interest by emailing enquiries@biologi.com.au.
We do not permit individuals buying our products for reselling and redistribution. Any such orders are a direct violation of our Terms and Conditions, and are subject to order cancellation or a reduction in quantity.

PRODUCT OWNERSHIP
When you have placed your order, we will send you an acknowledgement that we are processing your order, this is not an acceptance of ownership transfer. Biologi owns the products until we ship the goods to you with full payment.

PAYMENT
You may pay with Credit/Debit Card that belongs to you or that you have permission to use. All cardholders are subject to validation and authorisation checks by the card issuer. If the card issuer refuses payment to us, we are not liable for any delays or non delivery.

RISK
Risk of loss and damage of the products are passed onto you upon delivery. Although our products are carefully formulated, should you develop adverse reactions, we will not be held liable once ownership of product is passed onto you.

LIMITATION OF LIABILITY, INDEMNIFICATION, REPRESENTATIONS, WARRANTIES
This site and all its content, material, products, functions, pictures, and information are presented “as is”. There are no representations or warranties of any kind, direct or implied, in connection with the Terms and Conditions or the Site, including but not limited to: non-infringement for a specific purpose, warranties of merchantability, except to the extent such representations and warranties are not legally excludable.

Biologi accepts no liability arising from the website, or on links provided from the website, being incorrect, incomplete or misleading.  To the fullest extent permitted by law, Biologi will not be liable for any loss, damage, cost or expense incurred in or arising by reason of any person relying on the information from this website.

Where conditions and warranties implied by law cannot be excluded, Biologi limits its liability, where it is entitled to do so, to the resupply of the relevant service and goods, or payment of the monetary value of the resupply.

INDEMNITY

You agree to defend, indemnify and hold us harmless for any loss, damages or costs, including reasonable legal fees, resulting from any third party claim, action, or demand resulting from your use of the Site or breach of these Terms and Conditions. You also agree to indemnify us for any loss, damages, or costs, including reasonable legal fees, resulting from your use of software robots, spiders, or similar data gathering and extraction tools, or any other action you take that imposes an unreasonable burden or load on our infrastructure.

BIOLOGI SUBSCRIPTION PLAN Terms & Conditions

TERM: Biologi’s subscription plan will go on if you continue to make payments. Products will be available with 15% off. It can be terminated at any time of your choosing, without any penalties for you.

FEES: Biologi’s subscription plan has a fixed cost, which will be charged through a 1, 2 or 3 Month occurrence. The fee varies depending on the subscription plan the customer selects.

(i) Biologi’s subscription plan is only available to be paid by credit/debit/visa card this will exclude afterpay.

(ii) The first fee will be payable at the time you sign up to the Biologi subscription plan. All subsequent fees will be payable 1,2 or 3 months (depending on your subscription plan) on the same day of the month as when your subscription was activated.

(iii) Shipping fees will be charged according to the delivery address and total order amount. All international orders and domestic orders will be charged standard shipping rates every occurrence of the subscription. AUS orders over $150 Aud will receive free standard shipping. Express shipping options are not available for subscription orders. 

TERMINATION:

(i) You can terminate your subscription at any time. You may do so by accessing your account or by contacting our customer experience team via enquiries@biologi.com.au. You will not be entitled to a refund for any Fees already paid at the date of termination.

(ii) After Termination, no more payments will be made. You can re-create a subscription plan at any time.

OTHER CONDITIONS:

(i) Delivery: Free delivery applies to all subscriptions plans that meet the minimum FREE shipping requirements (Free shipping on AUS orders over $150Aud and international orders over $300aud).

(ii) Failed Payments: If you fail to pay the fee when due, Biologi’s automated system will reattempt again until successful for two consecutive days. If fees are not paid after this period Biologi may treat this as your giving notice of termination and will cancel the subscription.

(iii) Amendments: We may at any time amend the terms of this agreement by notice on the website or by email to you. Where an amendment could be reasonably expected to adversely affect you, we will give you reasonable notice of the variation having regard to the nature of the amendment. If you can demonstrate that the proposed amendment will have more than a minor detrimental impact on you, we can terminate your subscription without incurring any fee.

(vii) Security Checks: To ensure that your credit, visa, or debit card is not being used without your consent, we reserve the right to validate name, address and other personal information supplied by you during the order process against appropriate third-party databases. We also reserve the right to perform a credit check. By accepting these terms and conditions you consent to such checks being made.

(viii) Use with other offers: This offer is not available in conjunction with any other Biologi promotion.

(ix) Change of plan: you can change your plan type at any time and the calculated fee will be adjusted according to new plan selected.

(xi) Australian Consumer Law: These terms and conditions do not exclude or limit the application of any statutory provision (including a provision of the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any part of these terms and conditions to be void.

(xii) Tampering: The Promoter reserves the right to terminate the subscription plan if any individual tampers with the subscription process. Tampering includes but is not limited to the utilisation of techniques designed to avoid payment of the fees owing under this subscription.

(xiii) Technical malfunction: If for any reason this subscription is not capable of running as planned, whether caused by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other cause beyond the control of Biologi which corrupt or affect the administration, security, fairness, or integrity of the subscription, Biologi reserves the right in its sole discretion to modify the subscription plan.

(xiv) Exclusion: Employees of Biologi and their immediate family members are not eligible to redeem this subscription offer.

DISPUTES

Your use of this website and any services rendered shall be governed by Australian Law under the jurisdiction of the State of Queensland.
